Help 
My younger bro bought a pretty expensive metal detector (£500 S/H) from a dealer via internet. Dealer said in the blurb it was in 'Excellent condition with no marks or scratches' but when it turned up Monday it was anything but, scratches to the coil, lower shaft, upper shaft and battery compartment.
First email went off yesterday and second email went off this morning explaining that the condition is not what we expected for the money and could we please have a RMA... still nothing
He only has 7 days from order date to raise the concerns according to the company T&C, my worry is they will ignore emails until the 7 days are up then say sorry gringo.....
I did pay by Paypal but not sure if they will be of any help at all? Could try I suppose.......
What do you guys think?

They can't, you've raised your concern within 7 days for a return/refund therefore covered yourself IIRC.
If it was paid by PP then raise a dispute if they don't respond within a day or two and for peace of mind contact Consumer Direct and ask them for advice, this then gets them to open a case on the subject and keeps anything you tell them documented with a case number.
Hope you get it sorted out and remember they are liable for the postage costs both ways too as it's their fault the goods aren't satisfactorily described.

To the law you have raised your concern within the 7 days. If they choose to ignore it until after the 7 days it is irrelevant.
However, the distance selling act is only applicable in a Business to Consumer transaction. If it is a private sale then it doesn't apply

It seems brother dear has upset the metal detecting fraternity, all telling him to 'just use the ****ing thing and do you want to make love to it, scratches don't matter etc etc.... Easy for them I told him, wasn't there £550..... bunch of tits!
