S.O.G. Act, returning item with consumable...?

IIRC from my days in-store any item purchased with another to enable it to work can be returned if the main item becomes faulty.
This one is a bit odd so I had a shuftie online but can't find an answer.

That airswimmer shark I bought has stopped working (total use of about 30 minutes!!) so it's going back, but I had to buy s helium canister with it.
Both items were £40 each so this isn't just a 2 quid pack of batteries I'll be stuck with so can anyone clarify this for me before I take this in tomorrow?

You can't assemble the shark unless it's inflated so you can't even test for a bit without the said helium.

Easiest example of this would be buy a dvd/bd player to match a tv in same transaction along with cabling necessary and you were able to return both with all cables if one or the other was faulty but shouldvthat apply in this case?

I'm sure the Doc would know the legal standpoint, I'd ring the store and explain they may just take them both back as refilling the canistor might be easy to do for them or their supplier.

Both from Argos and it's a disposable canister so I'm guessing it'll be a bin job for that part

I would have thought if they offer to send you a replacement unit, then they will have done all they need to. You will have a working unit and 2 canistets as you wanted. If they have offered that but you don't want it any more, and just want the money back. I would take the view that the canisters are your problem.

Just my view. Not the law. I'm not sure on that to be honest.

Can you tell if the canisters have been used or not?

Yep you can tell the canister has been opened as it's in cardboard outer box.
I was so unimpressed with it ans the build quality is so bad I don't want another hence my queston.

Saying that if they did offer a replacement canister I would just sell it for a decent price to recoup costs.

Time for a call to TS to ask the legal standpoint, it's the £40 that's the sticking point as once the shark is refunded I'm still out £40. Cool

It's a difficult one. If the build quality is not up to what you were led to belive then I would expect the whole lot to be refunded. I wouldn't leave it till it was either.

I'll take some pictures before it goes back so all can see.
started working again, then stopped... Traced it to a very shoddy and hard to move on offswitch so must have a faulty contact or something.

Adding to that, the tape ( yes, you read that correctly) holding the fins and the mechanism in place has started to peel off so definitely not fit for purpose anyway.

Just getting over a massive cold too so this is gonna be fun. Suppose I better let some helium out if it for transport purposes lol.

Argos are one of the best retailers when it comes to refunds and exchanges so you've got that on your side too.

I think Jimbo is like a fish out of water with this one.
