No, you can't. If there's a question of identity regarding the driver, and neither party is willing to fess up, then by default the OWNER of the vehicle will receive the points and monetary fine. I seem to remember that if you deliberately refuse to name the driver, then another charge might be thrown in (failing to disclose information pertinent to a crime or something).
Fact is, unless you can prove otherwise, a law has been broken, and the guilty party must come clean. It's not nice, but it's the law, sonny-jim
