No, you can't. If there's a question of identity regarding the driver, and neither party is willing to fess up, then by default the OWNER of the vehicle will receive the points and monetary fine. I seem to remember that if you deliberately refuse to name the driver, then another charge might be thrown in (failing to disclose information pertinent to a crime or something).

Fact is, unless you can prove otherwise, a law has been broken, and the guilty party must come clean. It's not nice, but it's the law, sonny-jim

Clarkson did it,

http://www.autoblog.com/2007/09/08/he-fought-the-law-jeremy-clarkson-gets-out-of-speeding-ticket/

has he done it since cos I seem to remember the story being more recent than that but that's a few years ago, I just googled clarkson speeding fine

footballers, policeman, barristers have been known to get out of it, I think it all depends on how much money you have, celebrity status, how good your lawyer is and who you know.

so did a lot of people, 2 years ago. The law was changed about a year ago(citation needed) to prevent people with getting away with such crimes. Too many people were using the 'can't remember who was driving' defence and were indeed getting the cases thrown out.

If the story happened now, Alfa would be liable for the fine, but they'd either sue the arse off Clarkson or never let them test drive an Alfa Romeo on Top Gear again

Or use the publicity to their advantage. Winking

I consider myself an optimist, albeit an optimist with cynical tendencies and a dark side that Lucifer himself would find a little creepy. (Perhaps you’ve noticed.) You don’t normally associate cynicism with an upbeat pov. But I have exactly that combination and will defend it.

I'm sure people still argue the toss over this by checking road signs for obstructions and measuring callibration of equipment, etc. It's a lot of trouble to go to though but I'm sure there must be more specific information on the webs.

The owner of the vehicle doesn’t drive (hasn’t got a licence) will they just get the fine if they don’t know who’s driving?
