Who Owns Which Fence?

As it says on the tin?

Some sites say LHS, others say RHS??

Who owns the fence on either side of our garden...both could do with replacing but which one is ours?

Anyone have experince of this or any other stories?

I own the one on the right hand side. Best thing is to check your deeds. Only way to be sure.

In our area our fence is on the right. But because we have tightass neighbours we replaced the fence on the left as the other one was falling down & there were big gaps & we didn't want our dog wandering through. The fence on our right is ours & is also falling down because the neighbour lets ivy grow up it & it has destroyed the fence. I'd replace it tomorrow but he will just let the ivy grow back & it will be the same. Moan over. Fence on right looking towards bottom of garden from house is yours. But check with Town hall.

check the deeds.. personally i would speak to neighbours and see if you can come to an arrangement?

traditionally as you look out to your back garden from the house, you own the one on your left (at least I do)

Another way to tell is 1 fence will be nice and flat, and the other will show all the supports. You normally own the side showing supports! I would have thought it would be other way round, i.e. if I'm paying for the fence I should see the nice side of it Happy

My parents however are lucky and don't own either, as the side that was their's was a hedge, the neighbor thought a fence would be better, so agreed to pay for that hence that is their fence, so they have to do 2.

That caused arguments with the ppl that bought that house next, as it meant the bought a house, and had to look after 2 fences.

However I'm not a property lawyer, that's all v limited personal experience! Deeds should say!

As above- check your deeds- no hard & fast rule. At our old house, the fence at the rear, right side looking outwards from our property was our responsibility & the left side outwards was our neighbours responsibility.
At our current house, all shared fences are shared responsibilty.

Varies completely between areas and the original developers common practice at the time of building. In Scotland they are *usually* shared equally between both sides with equal responsibilty for repairs etc.

Only true way is to check your deeds, my Mum was in a similar situation recently when a neighbour 'sugested' the fence between the back gardens needed replacement ie hinting my Mum should replace the battered fence, she checked the deeds and found that the fence actually belongs to the neighbour. She lives on the corner of 2 streets so has 3 boundry walls, Mum is responsible for the end wall (hedge) the bottom wall is Mums too but the neighbour on that side is a builder who built a nice wall around his garden and asked if Mum minded him replacing the tatty fence with a wall so she said no as she was getting a free wall Happy The fence to the right (looking from the house) belongs to the snotty neighbour who suggested it needed replacement.

As a rule of thumb, you own the one in best condition

Or so it seems.

Often the deeds won't say who owns which fence, it will just show the line of the boundary. We own the fence on the right, we know this because the neighbours to the left replaced the other one last year Grinning
